Terms of Service

Welcome to SassCam.ai. These Terms of Service ("Terms") govern your access to and use of the SassCam.ai mobile application ("App") and related services provided by Shift Mind Labs LLC ("Company," "we," "us," or "our").

1. Acceptance of Terms

By accessing or using SassCam.ai, you confirm that:

• You are at least 13 years of age (or 16 in certain jurisdictions)
• If you are under 18, you have obtained parental or guardian consent
• You have the legal capacity to enter into a binding agreement
• You are not prohibited from using the App under applicable laws

If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

SassCam.ai is an AI-powered caption generation platform that:

• Analyzes videos and photos you provide
• Generates personality-driven captions using artificial intelligence
• Allows you to edit, customize, and export captions
• Provides various caption styles ("Vibes") to match your content

The App requires an internet connection to function. AI-generated captions may vary in quality and appropriateness.

3. Account Registration

3.1 Account Creation

To access certain features, you may create an account using:

• Sign in with Apple
• Google Sign-In

You may also use the App as a guest with limited functionality (one free caption generation per device).

3.2 Account Responsibilities

You are responsible for:

• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

3.3 Account Deletion

You may delete your account at any time through the App (Profile > Delete Account). Account deletion is permanent and will result in the loss of all associated data, including unused credits.

4. Subscriptions and Payments

4.1 Subscription Plans

SassCam.ai offers the following plans:

Credit packs are available for one-time purchase:

• 10 Credits - $4.99
• 25 Credits - $9.99
• 50 Credits - $17.99
• 100 Credits - $29.99

Credit packs expire 90 days from the date of purchase.

4.3 Payment Processing

4.4 Subscription Terms (Apple App Store)

• Billing: Subscriptions are billed through your Apple ID account at confirmation of purchase.
• Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.
• Management: You can manage and cancel subscriptions in your Apple ID Account Settings after purchase.
• Free Trial: Any unused portion of a free trial period will be forfeited when you purchase a subscription.

4.5 Refunds

All purchases are final. Refund requests must be submitted directly to Apple through their App Store support. We do not have the ability to process refunds for App Store purchases. For extenuating circumstances, contact us at support@shiftmindlabs.com.

4.6 Price Changes

We reserve the right to change subscription prices. Price changes will take effect at the start of your next subscription period following notice of the change.

5. User Content and Conduct

5.1 Your Content

You retain ownership of all videos, photos, and other content you submit to the App ("User Content"). By submitting User Content, you grant us a limited, non-exclusive, royalty-free license to process your content solely for the purpose of providing our services.

5.2 Content Restrictions

You agree not to submit content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
• Contains sexually explicit material involving minors
• Infringes any patent, trademark, copyright, or other proprietary rights
• Contains viruses or malicious code
• Impersonates any person or entity
• Is intended to deceive or mislead others

5.3 AI-Generated Content

Captions generated by our AI are provided "as is." You acknowledge that:

• AI-generated content may be inaccurate, inappropriate, or offensive
• You are solely responsible for reviewing and editing captions before use
• We do not guarantee the suitability of generated content for any purpose
• You should not rely on AI-generated content for professional, legal, or medical advice

5.4 Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Circumvent any technical limitations or security features
• Use automated methods (bots, scrapers) to access the service
• Interfere with or disrupt the App's infrastructure
• Share your account credentials with others
• Exploit the App to generate harmful, deceptive, or misleading content

6. Intellectual Property

6.1 Our Rights

The App, including its design, features, and content (excluding User Content), is owned by Shift Mind Labs LLC and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

6.2 Trademarks

"SassCam," "SassCam.ai," and related logos are trademarks of Shift Mind Labs LLC. You may not use these trademarks without our written permission.

6.3 Feedback

If you provide feedback or suggestions about the App, you grant us the right to use this feedback without compensation or attribution.

7. Privacy

Your privacy is important to us. Our Privacy Policy describes how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.

8. Disclaimers

To the fullest extent permitted by law, we disclaim all warranties, including:

• Merchantability and fitness for a particular purpose
• Non-infringement of third-party rights
• Accuracy, reliability, or completeness of AI-generated content
• Uninterrupted or error-free service
• Security of your data (though we implement reasonable safeguards)

9. Limitation of Liability

To the maximum extent permitted by law:

• No Consequential Damages: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
• Maximum Liability: Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.
• Force Majeure: We are not liable for delays or failures caused by circumstances beyond our reasonable control.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of these limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Shift Mind Labs LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

11. Termination

11.1 By You

You may stop using the App at any time. To fully terminate your relationship with us, delete your account through the App.

11.2 By Us

We may suspend or terminate your access to the App at any time, with or without cause, including if we believe you have violated these Terms. We will endeavor to provide notice when possible.

11.3 Effect of Termination

Upon termination:

• Your right to use the App immediately ceases
• All provisions that should survive termination will survive (including Sections 6, 8, 9, 10, and 13)
• We may delete your data in accordance with our Privacy Policy

12. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms with a new "Last Updated" date
• Sending an in-app notification for significant changes

Your continued use of the App after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App.

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

13.2 Dispute Resolution

Any dispute arising from these Terms or your use of the App shall be resolved as follows:

1. Informal Resolution: Before filing a formal claim, you agree to contact us at legal@shiftmindlabs.com to attempt to resolve the dispute informally.
2. Binding Arbitration: If informal resolution fails, disputes shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.
3. Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

13.3 Exceptions

The arbitration requirement does not apply to:

• Claims that qualify for small claims court
• Claims for injunctive relief to stop unauthorized use or abuse of the App
• Claims for intellectual property infringement

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Shift Mind Labs LLC regarding the App.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

14.5 No Agency

Nothing in these Terms creates any agency, partnership, or joint venture between you and us.

15. Apple-Specific Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and Shift Mind Labs LLC only, and not with Apple Inc. ("Apple").
• Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support services for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation.
• Apple is not responsible for addressing any claims relating to the App or your use of the App.
• Apple is not responsible for any third-party claims that the App infringes intellectual property rights.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.
